Terms of service
Acceptance
These Terms of Service ("Terms") govern your access to and use of Pagebase (the "Service"), operated from Belgium. By creating an account, accessing the Service, or clicking "I agree", you accept these Terms. If you don't agree, don't use the Service.
The service
Pagebase is a software-as-a-service platform that lets you visually design, host, and publish websites. Specific features depend on your plan and may evolve over time.
Your account
You must be at least 16 years old (or the legal age in your jurisdiction). You agree to provide accurate, complete information and to keep your password confidential. You are responsible for all activity under your account. Notify us immediately at security@pagebase.app of any unauthorised access.
One person or legal entity per account. Don't share login credentials. Multi-user collaboration is offered through the Agency plan.
Plans & payment
Pricing for each plan is shown on our pricing page. Prices exclude VAT, which is added at checkout where applicable.
Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless cancelled. Payment is processed by Stripe. By subscribing, you authorise recurring charges to your payment method.
Failed payments may result in suspension after a grace period. We'll notify you and give you the chance to update your payment method.
Cancellation & refunds
You may cancel your subscription at any time from your dashboard. You'll keep access until the end of the paid period; the plan then automatically reverts to Starter (free).
Outside of the legal cooling-off period below, paid periods are non-refundable. Domain registration fees are non-refundable once the domain has been registered with the registry, since they are paid through to a third party.
Right of withdrawal (consumers)
If you are an EU consumer, you have a 14-day right of withdrawal under Article VI.47 of the Belgian Code of Economic Law (transposing Directive 2011/83/EU). You can withdraw without giving any reason within 14 days of subscribing.
By starting to use the Service immediately after subscribing, you expressly request and consent to the supply of digital services beginning during the withdrawal period and acknowledge that you lose your right of withdrawal once the service has been fully provided. Acceptable use
You agree not to use Pagebase to:
- Publish illegal, infringing, defamatory, hateful, or harassing content.
- Distribute malware, phishing pages, or content that violates the rights of others.
- Send spam or unsolicited bulk messages.
- Reverse-engineer, scrape, or attempt to gain unauthorised access to the Service.
- Resell the Service except under the Agency plan, which permits reselling under your own brand.
- Engage in any activity that disrupts the Service or harms other users.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.
Your content
You keep ownership of everything you create on Pagebase. By using the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and create technical copies of your content solely to operate the Service for you (e.g. CDN distribution, backups).
You are solely responsible for your content and for ensuring you have the rights to publish it. We may remove content that violates these Terms or applicable law.
Our intellectual property
The Pagebase platform, software, brand, logo, and documentation are owned by Pagebase. These Terms do not transfer any of our IP rights to you, except for the limited licence to use the Service.
Service availability
We aim for 99.9% uptime but cannot guarantee uninterrupted service. Planned maintenance is announced in advance. We may modify features, with material reductions announced at least 30 days in advance.
Termination
You may close your account at any time. We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that creates legal risk. On termination, your sites become unpublished and your data is deleted after a 30-day grace period (except where law requires longer retention).
Disclaimers
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or perfectly secure.
Limitation of liability
To the maximum extent permitted by law, Pagebase's total liability under or in connection with these Terms is limited to the amount you paid us in the 12 months preceding the event giving rise to liability. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.
Nothing in these Terms limits liability that cannot be limited under Belgian law (e.g. fraud, gross negligence, or wilful misconduct).
Governing law & jurisdiction
These Terms are governed by Belgian law. Any dispute will be submitted to the exclusive jurisdiction of the courts of the Brussels judicial district, except where mandatory consumer-protection rules give consumers the right to bring proceedings before the courts of their place of residence.
EU consumers may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
Changes to these terms
We may update these Terms as the Service evolves. Material changes will be announced by email and on this page at least 30 days before they take effect. Continued use of the Service after the change means you accept the updated Terms.
